The US Federal Appeals Court ruled 7 – 4 that US President Trump cannot use the IEEPA Act to impose tariffs because the law does not specify tariffs as a potential remedy. Tariffs are a form of taxation, and the US Constitution restricts the power to impose taxes to the Congress, unless Congress specifically delegates this power.
